Constitutional Issues

The American Constitution is an extraordinary document.  It could have been written only by a Biblically based society.   President Harry S Truman stated in his address to the Attorney General's Conference, February 1950:   "The fundamental basis of this nation's laws was given to Moses on the Mount. The fundamental basis of our Bill of Rights comes from the teachings we get from Exodus and St. Matthew, from Isaiah and St. Paul." 

Some of the gathered attorneys general may have been snickering and rolling their eyes, but Truman was exactly right.  Our constitutional, democratic republic under God (what is left of it) is the Way of the Cross for politics -- we give up our right to "get our way", to win by power struggle, and instead let the truth and the Lord of truth speak for themselves on how coercive force shall (via law-making) be applied.  (See below on Biblical Government.) 

Christians, however, had long lost the capacity to defend the Biblical view in public.  We are ever so slowly learning how, half a century later, after disastrous 19th and 20th centuries.

An Amendment binding the Constitution to the Declaration of Independence -- We MUST link the two documents because the Constitution does not itself contain adequate reference to the values and spiritual core of why America was founded.  The Declaration points in the right direction.

Honoring God & the Ten Commandments - Pamphlet (pdf) from the Family Research Council by Justice Antonin Scalia.  We have been betrayed by our politicians.  The scuttling of our religious heritage is also the scuttling of our political freedoms.  As the Declaration of Independence accurately implies, either our freedoms come from God, or they do not come at all.
        Scalia gets a good start in his argument defending religion in public life,  but the case can be carried much more deeply and decisively.  See also Defining 'Oughtness' & 'Love', the argument that without God there is no morality, and thus no political authority.   The only law is the law of God - a view widely held in England and America at the time of the revolution. 
        That means that the acts of the Court were direct violation of our Constitution which they swore to defend.  On the battle field, that kind of behavior is treason and can bring the death penalty.  It is no different on the Court bench.  If the persons on that Court do not know how to support and defend the Constitution, they either should get off the bench or be subject to the most severe penalties.  They have succeeded in what all the wars of our history could not accomplish (with the partial exception of the war between the states), the destruction of our Constitution. 
        Either we Americans wake up to our own Biblical heritage and discipline our politicians, or we will continue to become increasingly slaves on our government plantation, no longer people who choose their own rulers, no longer the primary officers of state.

In 1909, President Theodore Roosevelt, who was a member of the Dutch Reformed Church, stated: "After a week on perplexing problems...it does so rest my soul to come into the house of The Lord and to sing and mean it, 'Holy, Holy, Holy, Lord God Almighty'....  (My) great joy and glory that, in occupying an exalted position in the nation, I am enabled, to preach the practical moralities of The Bible to my fellow-countrymen and to hold up Christ as the hope and Savior of the world." 
     The supposed separation between Church & State is bogus.  We have been betrayed, and have allowed the betrayers to get away with it.  (See What is Biblical Government.)  Teddy was a "progressive", that is a government centralizer.  But Americans had not yet sorted out what Biblical government is, and how to distinguish the extent of legitimate centralization.  They wrestled with obvious evils in the economy but did not see the dangers of centralization.  I did not see the point until late in my life, about 1992.  We are having to learn the hard way, but we do have a chance to not fall off the political cliff, and to return to a truly Biblical government for which the founding fathers gave us the foundations.  (See free online courses on the Declaration and Constitution at www.hillsdale.edu -- with other courses coming online  --   superb!)   E.             ADDENDA -- 8/6/05: I fear I am right.  Roberts has also helped the homosexual advocates argue the 1996 Romer v. A Conversation with Justice Scalia -- with Charles Rose Interviewing  (U-Tube).   Justice Scalia, who styles himself as an "originalist", sticking to the original language of the Constitution, is only partly "conservative", and does not visibly allow his Christian (Roman Catholic) religion to "interfere" with his judicial activities, especially on the "life vs. abortion" issue. 
         By his own words, he is NOT the conservative we have been led to believe.  He is NOT a seriously conservative constitutionalist, he is NOT really pro-life.   
        The interview is very well done, Rose does a good job of pulling things out of Scalia.  A very engaging hour.  But a sad commentary on the role of his Christian faith in one of our most important leaders. 
        Either we Christians learn how to articulate our faith reasonably and gracefully in public (emphatically on Biblical government), or the Church will continue in the backwaters of Western Civ.  And Western Civ. will continue downhill into oblivion and totalitarian paganism.  The homosexualized version will be mindlessly totalitarian to a degree only rarely seen in Western history.  A politics focused on feel-good rather than truth will always become totalitarian. 
        Is this what you want for your children and grand-children?   Do you want them to have to fight the battle for honest freedom which you and I should have fought already, at much less cost than they will have to pay???

        And then order the Fair Tax Book at Amazon or at www.fairtax.org to see what we should to do replace the IRS...., whether or not We, the People wins its case. 
        COMMENT:  The first link above is from June 2006, the second from January 2005.  The press is clearly not giving coverage to this issue.  Let's see where We, the People gets with this....  Success rate challenging  the IRS has not been good. 
        Also, see "The Perfect Tax", an alternative to the Fair Tax, at www.realityzone.com  (do search for title).  This might be better than the Fair Tax which is a national sales tax. 
        In any event, two good choices. 

More in the IRS -- and the lack of statutory authority to demand a 1040 on April 15.  The momentum seems to be growing, with more and more well researched persons challenging the government.
